Terms and Conditions

Version 3

These terms apply to membership and attendance at Xtasia and Flirts, operated by Xtasia Limited, 140 High Street, West Bromwich, B70 6JJ, United Kingdom. “You” means each applicant or member, including each person on a shared membership.

1. Joining and admission

You must be 18 or over, provide accurate details, show valid photographic ID and complete the joining process. Each person must accept these Terms and the Club Rules individually. The Club Rules include our Behaviour Rules and Safety Rules, presented with these Terms. If their wording conflicts, these Terms take precedence.

Membership does not guarantee admission to every event. Entry depends on the published eligibility rules, capacity, required bookings and payment. We apply admission decisions lawfully and reasonably.

Our Privacy Policy explains how we handle personal information, photographs and identity checks. It is provided for information, without requiring agreement. Marketing choices are separate and optional. Exercising your data-protection rights does not automatically end your membership.

2. Membership types and cards

Keep your membership details up to date. A couples membership normally permits the registered couple to attend together. One partner may attend alone only where the event rules allow it and reception confirms eligibility; otherwise, an appropriate individual membership is needed. Do not lend or transfer membership cards or accounts.

3. Consent and respect

Xtasia is an adults-only lifestyle venue where you may encounter nudity and consensual sexual activity. You may attend to socialise, dance or enjoy the atmosphere; participation is always optional.

Attendance, clothing and membership never imply consent. Obtain clear, freely given consent before intimate contact, respect its limits and stop immediately if it is withdrawn or uncertain. Someone who is asleep, unconscious or too intoxicated to decide cannot consent. Pressure, harassment, threats, discrimination, violence and unwanted contact are prohibited.

Follow reasonable staff instructions and tell staff if you feel unsafe or need help. These rules never prevent reporting to police or seeking medical, legal or safeguarding support.

4. Privacy, phones and recording

Respect other members’ privacy. Do not disclose their identity, attendance or private activities without permission or another lawful justification.

Store phones at reception and use them only in areas designated by staff. Ask staff about necessary medical or accessibility arrangements. Cameras and recording equipment are not permitted in member areas without management authorisation. Recording requires prior club permission and freely given permission from everyone identifiable.

If unauthorised recording is suspected, staff may ask you to stop and request voluntary cooperation. These Terms do not authorise forced device searches, password demands or destruction of equipment. Evidence may need to be preserved for police. Serious concerns may result in removal or membership action. Club CCTV is covered by the Privacy Policy.

5. Professional and official visits

Do not seek membership or attend covertly for journalism, research, publication or an official investigation. Disclose proposed professional visits to ownership in advance, except where a lawful power or obligation provides otherwise. These restrictions do not prevent protected disclosures, reporting suspected crime, giving evidence, confidential professional advice or lawful action by authorities.

6. Conduct and use of facilities

Follow the Behaviour Rules, Safety Rules and reasonable event instructions. In particular:

You are responsible for reasonable, evidenced repair or extra cleaning costs caused by your deliberate acts, negligence or rule breaches, not ordinary wear or damage for which you are not at fault. Extra cleaning caused by shoes on beds may cost up to £20, limited to the actual reasonable cost. We will explain charges and will not charge twice for the same loss.

7. Fees, cancellation and refunds

Membership duration, fees and separate event or booking charges are explained before purchase.

If you change your mind during your first visit, tell reception and we will cancel your membership and refund the membership fee in full. Our voluntary change-of-mind refund is available only on that first visit. Event admission, accommodation and other purchases have their own refund terms.

Your statutory cancellation and refund rights remain unaffected, including any applicable cooling-off period for an online or off-premises purchase. A first visit does not itself remove those rights. If we end membership without a substantiated breach, we will provide a fair refund for unused membership, taking account of its type and duration. Contact reception or our website contact service for cancellation or refund requests.

8. Removal, suspension and bans

We may refuse entry, remove someone, suspend access or revoke membership where reasonably necessary to address a breach, investigate a serious concern, protect people or property, or comply with the law. Action will reflect the circumstances; urgent safety risks may require immediate removal.

Where appropriate and safe, we will explain the concern and give you an opportunity to respond. You may ask ownership to review a decision, without requiring disclosure of another person’s confidential information.

Bans are permanent unless ownership decides to lift them; a review does not guarantee reinstatement. Suspensions are temporary, with their duration or review arrangements explained where practicable. Membership action does not remove statutory refund rights. Retained incident and restriction information is handled under the Privacy Policy.

9. Belongings and responsibility

Take reasonable care of your belongings and other people’s safety. Report loss, damage, injury or hazards to staff.

We remain responsible where required by law, including for failure to exercise reasonable care in our services or agreed storage. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability or consumer right that cannot lawfully be excluded. Attendance does not waive remedies for harm or signify acceptance of unlawful conduct.

10. Changes and additional event rules

Material event conditions will be available before booking or payment. Reasonable safety instructions may also be given during an event; they do not authorise undisclosed charges or remove statutory rights.

We may update these Terms and Club Rules for legal, licensing, safety or operational reasons. We normally give at least one month’s notice of material changes, using direct communication where appropriate. Urgent legal or safety changes may take effect sooner, with an explanation as soon as practicable.

Changes will not be applied unfairly to existing paid memberships or bookings. Where renewed acceptance is needed, we will request it. If a material change disadvantages you and you decline it, you may end membership and request a fair refund for unused prepaid membership. Updating a privacy notice does not obtain consent to a new use of information.

11. Questions and applicable law

Raise questions or complaints with reception, through our website or in writing to Xtasia Limited at the address above. Privacy enquiries: privacy@xtasia.co.uk.

The law of England and Wales applies, without removing mandatory consumer protections or your right to use a court available under applicable law. If a provision is unenforceable, the remaining provisions continue where lawful and fair.

Your declarations

Each member makes these declarations individually. Privacy information and optional marketing choices are separate from this acceptance.
